In most cases, Texas law gives you two years from the date of the injury to file a personal injury lawsuit, under Texas Civil Practice and Remedies Code § 16.003. Certain exceptions can shorten or extend this window, so it's worth talking to an attorney as soon as possible after an accident.

It depends on whether your employer carries workers' compensation insurance, and in Texas, that's optional. Unlike most states, Texas doesn't require private employers to carry workers' comp coverage. Employers who opt out are called "non-subscribers." According to the Texas Department of Insurance, roughly 25% of private-sector Texas employers were non-subscribers as of 2022. If your employer is a subscriber, workers' comp benefits are generally your exclusive remedy against that employer under Texas Labor Code § 408.001. But if your employer is a non-subscriber, that protection doesn't apply, and you can typically sue your employer directly for negligence, often recovering more than workers' comp benefits would have provided.

Often, yes, and this is a separate issue from the non-subscriber question above. Even when a plant or refinery owner's own employees are limited to workers' comp remedies, that protection under Texas Labor Code § 408.001 only applies to the employer-employee relationship. It doesn't shield that company from claims by workers employed by a different business, such as a contractor or subcontractor, injured on-site due to that company's negligence. This is a common situation at refineries and chemical plants, where multiple companies' crews are often working the same site at the same time.

Yes, in many cases. Even a properly repaired vehicle can carry a "diminished value," meaning it's worth less on resale simply because it was in an accident. Texas law allows injury victims to pursue this loss as part of a claim in many circumstances.

Yes. If a facility's negligence, such as a poorly managed evacuation, inadequate alarms, or unsafe emergency exits, contributes to an injury during an evacuation, the people affected may have a valid negligence claim, even if the injury wasn't caused directly by the chemical release or explosion itself.

Call the police so a report is filed, exchange information with the other driver, and photograph the scene if you're able to safely do so.
